Terms of Use

By accessing the Adams USA LLC DBA: Flyfill website, submitting an application, or using any Adams USA LLC DBA: Flyfill service, you acknowledge that you have read, understood, and agree to be bound by this Agreement and by any additional terms presented at the point of a specific product or offer.

If you do not agree with any part of this Agreement, you must not access or use the Adams USA LLC DBA: Flyfill site or services.

Adams USA LLC DBA: Flyfill is a financial technology company and a direct lender. Adams USA LLC DBA: Flyfill helps businesses evaluate financing options, provides customers with small business loans, lines of credit, term loans, and provides budgeting, reporting, and banking-adjacent software. Before makign any decision or implementing any strategy you should consider obtaining additional information and advice from your accountant, attorney, and/or other certified financial professionals.

Adams USA LLC DBA: Flyfill makes credit decisions based on the data submitted in the application along with publicly available data and data available by our third party authorized vendors including background checks and other investigative reports, or any other document or data that we reasonably believe may be necessary to determine your eligibility for an extension of credit. We do not guarantee that any application will be approved, or approved on any particular rate, amount, or term. Funding decisions, ranging from instant to 2 hours in many cases, are made by digital and human under-writing experts using our own underwriting criteria.

You must be at least 18 years old and authorized to act on behalf of the business you represent. You agree that all information you provide is accurate, current, and complete, and that you will keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at security@flyfill.com of any unauthorized use.

You may use the site and services only for lawful business purposes. You agree not to scrape, reverse engineer, resell, or attempt to gain unauthorized access to any part of the platform, and not to interfere with its operation or security.

The Adams USA LLC DBA: Flyfill name, the Netto name, our logos, software, content, and the arrangement of that content are owned by Adams USA LLC DBA: Flyfill or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to access the site for your internal business use.

While you may use the Website or Services without registering, certain functionalities or areas of the Website require you to register and create a username and password in order to access such portions of the Website. You may not share your username or password with others. You are solely responsible for (i) authorizing, monitoring, and controlling access to and maintaining the confidentiality of your username and password; (ii) informing us, in writing, of any need to deactivate a username due to security, confidentiality, or other concerns; and (iii) any charges or damages that may be incurred by use of your username and password, for any reason, until such time as you tell us to deactivate your account or other such notification that your account has been compromised or such other unauthorized use. We are not liable for any harm related to any authorized or unauthorized use of your username or password.

By opting in to receive SMS text messages from Adams USA LLC (dba Flyfill), you agree to the following terms:

Program Description: We send transactional messages strictly to applicants regarding business funding applications, including status updates, underwriting document requests, and account servicing alerts.

Message Frequency: Message frequency varies (up to 3 messages per day).

Cost: Message and data rates may apply.

Opt-Out (STOP): You may opt-out of SMS communications at any time by replying STOP to any text message received from us. After replying STOP, you will receive one final message confirming your opt-out.

Support (HELP): For assistance, reply HELP to any text message or contact our support team at support@flyfill.com.

Privacy: Phone numbers collected for SMS consent will not be shared, sold, or rented to third parties or affiliates for marketing purposes.

The site and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing on the Adams USA LLC DBA: Flyfill site constitutes legal, tax, accounting, or investment advice.

To the maximum extent permitted by law, Adams USA LLC DBA: Flyfill and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising out of your use of the site or services. Our aggregate liability will not exceed the greater of the fees you paid Adams USA LLC DBA: Flyfill in the twelve months preceding the claim or $100.

This Agreement is governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute will be resolved by binding arbitration on an individual basis, except that either party may seek injunctive relief in court to protect its intellectual property.

We may update this Agreement from time to time. Material changes will be reflected in the “last updated” date above, and continued use of the services after that date constitutes acceptance.
